General conditions of Tickehouse Holding B.V. for the sale of tickets and other access rights to concerts, shows, sports events and other events.
§1. Scope of these General Terms and Conditions, Subject of the Agreement, Meaning of General Terms and Conditions of the Organizers and Service Providers.
(1.1) The following general terms and conditions (hereinafter: "GTC") apply to all contractual relationships between us, Tickethouse Holding BV, Venlo, the Netherlands (hereinafter: "Tickethouse BV") and the customer, who arrange the sale and delivery of tickets and other access rights (hereinafter referred to as "Tickets") for concerts, shows, sports events and other events (hereinafter: "Events") are the subject of, and exclusively. The terms and conditions apply to all contracts that the customer concludes with Tickethouse B.V with regard to the items shown in the online shop of the Tickethouse B.V (www.alphatickets.net). We do not acknowledge any conflicting or deviating terms and conditions of the customer, even if we carry out the delivery to the customer unconditionally in the knowledge of conflicting or deviating terms and conditions of the customer.
(1.2) Tickethouse B.V is not itself the organizer of the events, for the tickets offered in the online shop (hereinafter referred to as "Tickets"). Responsible for the respective event is the respective organizer. By purchasing tickets through us, contractual relationships are established with the organizer of the event. If necessary, the general terms and conditions of the organizer may additionally be applicable to this contractual relationship with the organizer.
§2. Contract conclusion, purchase / - order processing
(2.1) The article representations contained under www.alphatickets.net serve for the delivery of a legally binding offer by the customer and do not constitute a binding offer.
(2.2) Tickethouse BV can accept the offer of the customer within 4 days by sending to the customer a written order confirmation or an order confirmation in text form (fax or e-mail), where the access of the order confirmation to the customer is decisive, or by he delivers the ordered goods to the customer, in which case the access of the goods to the customer is decisive, or by requesting the customer to pay after submitting his order. If more than one of the alternatives mentioned above, the contract comes into effect at the time when one of the aforementioned alternatives occurs first. If the seller does not accept the offer of the customer within the aforementioned period, this shall be deemed a rejection of the offer with the consequence that the customer is no longer bound by his declaration of intent. The period for the acceptance of the offer begins on the day after the sending of the offer by the customer to run and ends with the expiration of the fourth day, which follows the dispatch.
(2.3) The customer may submit the offer via the online order form integrated in the online shop of the seller. In this case, after the customer has placed the selected tickets in the virtual shopping cart and has gone through the electronic ordering process, by clicking on the button concluding the ordering process, the customer submits a legally binding contract offer with regard to the tickets contained in the shopping cart. Furthermore, the customer may submit the offer by telephone, fax, e-mail or post to the seller.
(2.4) A purchase contract is only concluded when we accept your binding order by delivery or order of the tickets or by confirming the acceptance in text form by a separate notification by e-mail. Therefore, no binding purchase agreement is concluded with your order. However, your order will be accepted within four working days at the latest.
(2.5) Tickethouse B.V sells the tickets as a reseller by way of legal purchase; the tickets are a so-called small bearer paper i.S.v. § 807 BGB, from which all claims (such as access to and execution of the event) are directed exclusively against the organizer of the event. With the sending of the ticket, which grants the customer the aforementioned rights (according to the respective ticket and the valid in connection with this organizer-AGB in addition to other provisions as well as possibly supplementary applicable law) to the organizer, has Tickethouse BV its obligations under the Completed legal purchase. In particular, Tickethouse B.V is not a party to the legal relationship arising from the acquisition of the customer's title on the ticket between the latter and the organizer.
(2.6) The granting of certain grandstands, rows, seats or other attributes below the place category (hereafter total: "Specification") can not be guaranteed by us and is not part of the contract.
(2.7) in favor of the customer. This is true even if certain specifications could be booked during the ordering process. In this context, Tickethouse B.V reserves the right to deliver at least equivalent tickets of the same category to it in the event of unavailability of certain grandstands, series, etc., taking into account the interests of the customer.
(2.8) The information about the events will be given to the organizer by Tickethouse B.V. For the correctness of the information made in the on-line appearance of the Tickethouse B.V no guarantee is taken over. This even applies to information that does not originate from the organizer or refers to data that are not directly related to the event.
(2.9.1) Your data, which you have specified during the ordering process, will be stored by us and can be retrieved by you after sending your order via the password-protected customer account set up at first order.
(2.9.2) The purchase / - order processing and communication take place via e-mail and automated order processing. The customer must ensure that the e-mail address provided by him for the order processing is correct, so that he can receive the e-mails we have sent under this e-mail address.
§3. Prices and payment methods, Alphatickets seal
(3.1) The prices quoted for the Tickethouse B.V are total prices and include statutory value added tax. If necessary, additional delivery and shipping costs are specified separately in the respective item description. The sales prices and category breakdowns may differ from the prices and category breakdowns of the respective organizer printed on the tickets.
The procurement of the tickets is partly carried out by external agencies / or third parties. Therefore, our selling prices may differ significantly from the original issue price.
Many customers give away the tickets purchased from us as part of business invitations, Christmas gifts or company outings, etc. Therefore, we have decided, on repeated customer request, to provide the ticket price information with our Alphatickets seal.
(3.2) We charge a one-time service / shipping fee. The amount of this lump sum depends on the delivery address of the customer. Before ordering, these costs are shown separately.
(3.3) The respective final price is due immediately after conclusion of the respective contractual relationship (s) and has to be paid in advance to us. We offer the following payment options, unless otherwise stated in the article view in the online shop:

§4. Delivery and shipping conditions / reservation of self-delivery.
(4.1) Tickets are always delivered by post to the delivery address specified by the customer during the ordering process. The shipping is guaranteed no later than 3 days before the start of the event.
(4.2) If the carrier sends the tickets back to the seller, as it was not possible to deliver to the customer, the customer will bear the costs of unsuccessful shipping. This does not apply if the customer is not responsible for the circumstance leading to the impossibility of delivery or if he was temporarily prevented from accepting the service offered, unless the seller has informed him of the service a reasonable time in advance would have.
(4.3) If the customer acts as an entrepreneur, the risk of accidental loss and accidental deterioration of the tickets sold passes to the customer as soon as the seller has delivered the goods to the carrier, the carrier or the person or institution otherwise responsible for carrying out the shipment , If the customer acts as a consumer, the risk of accidental loss and accidental deterioration of the tickets sold generally only with the transfer of the tickets to the customer or a person entitled to receive. (4.4) Tickethouse B.V reserves the right to withdraw from the contract in the event of improper or improper self-delivery. Tickethouse B.V will make every reasonable effort to obtain the tickets. (4.5) In the case of pickup, the customer may pick up the ordered tickets upon prior agreement with the seller by presenting the seller's electronic confirmation of purchase and a valid photo ID (identity card or passport) either at the seller's premises or in another suitable location or on Receive the day of the event at the venue from a sales representative of the seller. If the parties have agreed to hand over the tickets through a sales representative of the seller, the seller will inform the customer in good time before the event date by e-mail about all necessary transfer details, such as the transfer date and contact details of the contact person on site. (4.6) The choice between shipping or handover lies with Tickethouse B.V; The latter is merely a special, optional service of Tickethouse B.V. Tickets are shipped promptly (i.e., with sufficient lead time before the event) after Tickethouse B.V has received them and the customer has fulfilled his payment obligations. It should be noted here that some (especially foreign) organizers spend the tickets shortly before the event takes place and, of course, Ticket House B.V can not deliver any more.
§5. Refund claims of the customer in case of cancellation or postponement of the event.
(5.1) Tickethouse B.V is not liable for the contractual execution of the event. The contractual implementation of the event is the responsibility of the respective organizer. In the event of disruption to performance during the performance of the event (eg a date postponement or cancellation of the event), the customer may contact the respective organizer.
(5.2) Irrespective of this, the customer may instruct the seller to settle a refund to the organizer in the event of a failure of the event without replacement. In this case, the customer must return the tickets purchased from the seller immediately, but at the latest within two weeks after cancellation of the event and notification by the seller to the seller. Decisive in this respect is the date of dispatch of the tickets. By placing the order, the customer also gives the seller the necessary representation and power of attorney. The seller owes only the one-time transmission of the reimbursement demand to the appropriate organizer on behalf of the customer and not also its successful enforcement. In the event of a refund by the organizer, the seller will transfer the refund amount immediately, but no later than two weeks after receipt of payment to the bank account of the customer. In this respect, the date of the transfer order for the executing bank is decisive. The customer is advised that the refund amount may be lower than the ticket purchase price paid by the customer, as the organizer usually reimburses only the price charged on the ticket.
(5.3) After expiry of the period of two weeks specified in Section 5.2, the customer can only apply to the organizer for any refund after replacement of an event without replacement, subject to its General Terms and Conditions.
(5.4) In case of temporal and / or local relocation of the event, the tickets remain valid. A return to us is therefore excluded. Any deviating provisions of the organizer are governed by its General Terms and Conditions.
(5.5) In the event of performance disruptions in connection with the performance of the event (eg cancellation of the event, cancellation of the event, short-term change of the stage setup, exchange of band members), the existence of any (partial) refund claims of the customer against the organizer in accordance with the statutory provisions and the supplementary terms and conditions of the organizer.
(5.6) We endeavor to inform our customers in good time about the cancellation or postponement (local and temporal postponement) of the event. Due to occasional, short-term cancellations, the customer is required to inform himself in the (local) daily press about the actual performance of the event.
§6. Reservation of the allocation of higher ticket categories, control of tickets by the customer
(6.1) In individual cases, Tickethouse B.V reserves the right to award the customer a higher (more expensive category) ticket than the booked category. There are no additional costs for the customer due to this allocation. In case of allocation of places close to the stage, it may be the case in individual cases that a note is printed on the tickets, which indicates an approximately existing visual restriction. As a rule, there is actually, if at all, a slight visual restriction on these scenes close to the stage. An allocation of such aforementioned tickets are therefore reasonable for the customer.
(6.2) As soon as the customer has received his purchased tickets, he is obliged to check them within two weeks, if you agree with his order in compliance with the provisions of section 6.1. In particular, pay attention to the date and place.
(6.3) If no objections (e-mail, text form or by telephone) are received from the customer within the specified period, the delivery of the tickets is considered valid. The customer is separately informed when sending the tickets, the start of the term and the intended meaning of his behavior.
§7. Warranty, liability
(7.1) The statutory provisions on liability for defects apply to all goods offered by us.
According to § 312g Abs. 2 Nr. 9 BGB, unless otherwise agreed, a right of revocation does not exist for contracts for the provision of services in connection with leisure activities, if the contract provides for a specific date or period for the provision. Thereafter, a right of withdrawal is also excluded for contracts that have the sale of tickets for on-time events to the object.
§9. Applicable law, jurisdiction, customer service
(9.1) The contract between the customer and us shall be governed by the law of the Federal Republic of Germany, excluding the Convention on Contracts for the International Sale of Goods (CISG).
(9.2) If the customer is an entrepreneur, the exclusive place of jurisdiction for all disputes arising from this contract is Venlo, Netherlands. However, we are entitled to sue the customer at his general place of jurisdiction.
(9.3) For questions, suggestions, etc., the customer can contact our customer service via e-mail or via our (paid) telephone hotline. The working languages of our customer service are German, English and Dutch. Contact in other languages can not be edited.
